{"id":475,"date":"2019-11-27T11:02:36","date_gmt":"2019-11-27T11:02:36","guid":{"rendered":"https:\/\/do.radiusccc7.com\/thedefensegroup\/?page_id=475"},"modified":"2021-02-23T02:50:39","modified_gmt":"2021-02-23T02:50:39","slug":"aggravated-stalking","status":"publish","type":"page","link":"https:\/\/do.radiusccc7.com\/thedefensegroup\/aggravated-stalking\/","title":{"rendered":"AGGRAVATED STALKING"},"content":{"rendered":"<h1>AGGRAVATED STALKING UNDER FLORIDA LAW<\/h1>\n<h2>What is aggravated stalking?<\/h2>\n<p><strong>How does Florida law classify stalking?<\/strong><br \/>\nWhile simple \u201cstalking\u201d is ordinarily charged as a misdemeanor, the offense of \u201caggravated stalking\u201d as set out below in FSS.784.048(3), is a third-degree felony:<\/p>\n<p><strong>784.048 Stalking; definitions; penalties<br \/>\n(3) Any person who willfully, maliciously, and repeatedly follows, harasses, or cyberstalks another person, and makes a credible threat with the intent to place that person in reasonable fear of death or bodily injury of the person, or the person\u2019s child, sibling, spouse, parent, or dependent, commits the offense of aggravated stalking, a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.<br \/>\n<\/strong><br \/>\nIn addition to the offenses listed above, there are a number of otherwise misdemeanor assaults and batteries that are reclassified to felonies based upon the victim being a member of a protected class.
